Honduran Legion
General principles.
The Honduran Legion guarantees the protection of rights such as habeas data, privacy, intimacy, good name, image, and autonomy. To this end, all actions will be governed by the principles of good faith, legality, information self-determination, freedom, and transparency.
Anyone who, in the course of any activity, may provide any type of information or personal data to Legión Honduras, and in which it acts as the data processor or data controller, may access, modify, or update such information.
The Honduran Legion will always keep in mind that personal data belongs to the individuals to whom it refers and that only they have the power to make decisions regarding it.
The Honduran Legion will guarantee the right of access upon verification of the data subject's identity, making the respective personal data available to the data subject free of charge. Such access must be offered without any restrictions and must allow the data subject the opportunity to review and update the data.
This policy is framed within the provisions of the Political Constitution.
Definitions
Authorization: Prior, express and informed consent of the owner to carry out the processing of personal data.
Database: Organized set of personal data that is the object of processing.
Personal data: Any information linked to or that can be associated with one or more specific or identifiable natural persons.
Sensitive data: Data that affects the privacy of the data subject, such as racial or ethnic origin, political orientation, religious or philosophical beliefs, membership in trade unions, social organizations, human rights organizations, data relating to health, sexual life, and biometric data.
Data processor: Natural or legal person who processes personal data on behalf of the data controller.
Data controller: Natural or legal person who decides on the database and/or the processing of data.
Data subject: Natural person whose personal data is being processed.
Processing: Any operation or set of operations on personal data, such as collection, storage, use, circulation or deletion.
Specific principles
The following specific principles will apply to the processing of personal data:
a) Principle of legality: The provisions in force for the processing of personal data and other fundamental rights will be applied.
b) Security principle: Personal data will be protected to the extent that technical resources allow, preventing its adulteration, loss, consultation, and, in general, against any unauthorized use.
c) Confidentiality Principle: All persons who administer, manage, or have access to information contained in databases agree to maintain the strictest confidentiality of all personal information received in the course of their duties. Persons currently employed or hired in the future for this purpose in the administration and management of databases must sign an additional agreement to their employment or service provision contract to ensure this commitment. This obligation persists and is maintained even after their relationship with any of the tasks involved in the Processing process has ended.
d) Principle of freedom: Data processing may only be carried out with the prior, express, and informed consent of the Data Subject. Personal data may not be obtained or disclosed without prior authorization, or in the absence of a legal, statutory, or judicial mandate.
e) Principle of truthfulness: The information must be truthful, complete, accurate, up-to-date, verifiable and understandable.
f) Principle of transparency: The processing of personal data must guarantee the right of the Owner to obtain information about the existence of any type of information or data that may be of interest to him/her.
g) Principle of purpose: Data processing will serve a legitimate purpose, which must be communicated to the respective owner of the personal data.
h) Principle of restricted access and circulation: Personal data, except for public information, may not be made available on the Internet or other mass media, unless access is technically controllable.
Duties of the Honduran Legion, as the party responsible for the processing of personal data.
Legion Honduras, when acting as Controller of personal data, will comply with the following duties:
a) Guarantee the Holder, at all times, the full and effective exercise of the right of habeas data.
b) Ensure that the information provided to the data controller is truthful, complete, accurate, up-to-date, verifiable and understandable.
c) Keep the information under the necessary security conditions
d) Request and keep a copy of the respective authorization granted by the owner.
e) Duly inform the owner about the purpose of the collection and the rights to which he or she is entitled by virtue of the authorization granted.
f) Inform the Owner, upon request, about the use given to their data.
g) Update the information, communicating it in a timely manner to the data controller.
h) Demand that the Data Processor respect the security and privacy conditions of the Data Subject's information at all times.
i) Rectify information when it is incorrect and communicate the relevant information to the data controller.
j) Process queries and complaints.
k) Provide the Data Processor, as the case may be, only with data whose processing has been previously authorized.
l) Inform the data protection authority when security code violations occur and there are risks in information management.
Rights of information holders.
The owner of personal data has the following rights:
a) Access, know, rectify and update your personal data.
b) To receive information from Legion Honduras, upon request, regarding the use that has been given to your personal data.
d) Go before the legally constituted authorities and file complaints for violations of the provisions of the current regulations in the applicable rules, after consulting or requesting the Data Controller.
e) Modify and/or revoke the authorization and/or request the deletion of the data.
Claims.
Data Subjects who believe that the information contained in a database should be corrected, updated, or deleted, or who become aware of a presumed breach of any of the obligations contained in the Law, may file a complaint with the Data Controller.
Procedure to guarantee the right to file complaints.
At any time and free of charge, the data subject may request that Legion Honduras staff correct, update, or delete his or her personal data, upon providing proof of identity. This right may be exercised:
a) The owner, after proving his identity.
b) Your representative, upon accreditation.
The request for rectification, update, or deletion must be submitted through the means enabled by Legion Honduras, as indicated in the privacy notice, and must contain, at a minimum, the following information:
a) The name and address of the owner or any other means to receive the response
b) Documents proving the identity of your representative.
c) The description of the personal data in respect of which the owner seeks to exercise any of the rights.
Data deletion.
The data subject has the right, at any time, to request that Legion Honduras deletion, whenever it deems appropriate. This deletion entails the total or partial elimination of personal information, as requested by the data subject.
It is important to note that the right to cancellation is not absolute and the data controller may refuse to exercise it when:
a) The owner who has a legal or contractual obligation to remain in the database.
b) The deletion of data hinders judicial or administrative proceedings related to tax obligations, the investigation and prosecution of crimes, or the updating of administrative sanctions.
c) Data necessary to protect the legally protected interests of the data subject; to carry out an action in the public interest; or to comply with a legal obligation of the data subject.
Data protection function within the company.
The Honduran Legion designates the Marketing department, or the department acting in its place, as the entity that will receive, process, and channel the various requests received. The department must process the data subjects' requests, in the terms, timeframes, and conditions established by current regulations, for the exercise of the rights of access, consultation, rectification, updating, deletion, and revocation that each person has over their personal data.
